Terms of Service

These Terms of Service ("Terms") govern your access to and use of Microsoft Call, a video communication platform operated by Microsoft Call, Inc. Please read these Terms carefully. By creating an account or using any feature of the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Microsoft Call (the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Microsoft Call is a video communication platform that enables users to host and join secure voice and video calls. The Service includes meeting hosting, screen sharing, encrypted communication, and related collaboration features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without prior notice.

3. Eligibility

You must be at least 16 years of age to use the Service. By using Microsoft Call, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. The Service is not intended for individuals who have been previously suspended or removed from Microsoft Call.

4. Account Registration

To access certain features of the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

5. User Conduct

You agree to use the Service in compliance with all applicable laws, regulations, and these Terms. You will not use the Service for any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable purpose. We reserve the right to investigate and take appropriate action against any violation, including suspension or termination of accounts.

6. Prohibited Activities

You may not, and may not permit any third party to: (a) reverse-engineer, decompile, or attempt to extract the source code of the Service; (b) use automated scripts, bots, or scrapers to access the Service; (c) interfere with or disrupt the Service or its infrastructure; (d) record meetings without obtaining the consent of all participants where required by law; (e) transmit viruses, malware, or any other harmful code; (f) impersonate any person or entity or misrepresent your affiliation; (g) collect or harvest personal information about other users without their consent.

7. User Content

You retain all rights to content you transmit, upload, or otherwise make available through the Service ("User Content"). By using the Service, you grant Microsoft Call a limited, non-exclusive, royalty-free license to process, store, and transmit your User Content solely to the extent necessary to provide the Service to you and other participants you have invited.

We do not claim ownership of your User Content and do not use it to train artificial intelligence models or for advertising purposes.

8. Intellectual Property

The Service, including all software, text, graphics, logos, trademarks, and other materials, is owned by Microsoft Call, Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written consent.

9. Privacy

Your privacy is important to us. Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

10. Termination

You may terminate your account at any time by closing it through the Service settings. We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms, engage in fraudulent or harmful conduct, or for any other reason at our reasonable discretion.

Termination does not affect any rights or obligations that accrued prior to termination, including payment obligations and provisions that by their nature should survive.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, completely secure, or free from viruses or other harmful components. Your use of the Service is at your sole risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Microsoft Call, Inc., its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total cumulative liability for any claim arising from or related to these Terms or the Service shall not exceed the greater of one hundred US dollars (USD 100) or the amount you paid to us in the twelve (12) months preceding the claim.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will provide notice through the Service or by other reasonable means, such as by email. The updated Terms will become effective on the date stated at the top of these Terms. Your continued use of the Service after that date constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Microsoft Call, Inc. is incorporated, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or the Service shall be resolved exclusively in the competent courts of that jurisdiction.
